01

Your use of this e-mail system for communication with any e-mail address confirms your consent to receive e-mail from any e-mail address and irrevocable acceptance of these terms as updated periodically, including but not limited to those presented, to the exclusion of all others. As such please do not communicate with us if you do not wish to be bound by these terms. [20190523 JSRDS E-MAIL ACCESS TERMS].

02

You irrevocably agree that any unauthorised usage of this system and our servers generally as determined solely by us, may be considered a breach of the UK Computer Misuse Act 1990 and you irrevocably agree to submit to the non-exclusive jurisdiction of England & Wales.

03

You irrevocably agree that any communications of any nature including but not limited to deceptive e-mail content and contrived voice conversations which may mislead and/or permit an illusory position to be fabricated may be a breach of the UK Fraud Act 2006 Section 7 (“making or supplying articles for use in frauds”) and disseminating such material may be an additional breach under Section 6 (“possession of articles for use in fraud”) and you irrevocably agree to submit to the non-exclusive jurisdiction of England & Wales.

04

You irrevocably authorise us to use and publish via any medium any communications connected with our systems for any purpose whatsoever, including but not limited to forensic analysis, for the prevention and detection of crime, and as evidentiary material.

05

You irrevocably agree that your e-mail is not considered delivered until we manually write to you confirming we have received it regardless of any notices you receive from our systems.

06

You may apply for general e-mail access at https://www.jsrds.email . Should you be a lawyer or an accountant then please use https://www.jsrds.lawyer or https://www.jsrds.accountant to apply for access. Should you wish to serve documents via e-mail or other electronic means then please apply via https://www.jsrds.legal .

07

Unless you receive confirmation by phone that your address is whitelisted your e-mails will be automatically deleted without human intervention. One application per each e-mail address is required and processing of applications takes around 21 days.

08

Electronic mail and processing facilities are handled by a number of different legal entities, humans and machines. Sophisticated filters are in place which automatically reject and delete messages from senders who are not specifically authorised on a per user and/or per domain basis.

10

You may or may not get autoresponse messages from the system upon rejection and delayed notification is often used. In view of the proliferation of malware, attachments are automatically stripped and e-mails are converted to plaintext before they are delivered. Autoresponders and/or filters may be relaxed intermittently and without notification.

11

The absence of a rejection notice does not infer that your e-mail has been successfully delivered or read and do not use system autoresponses as delivery confirmation. On occasions, our messages may be incorrectly processed by your systems as junk mail. It is your responsibility that you configure your systems so that you are able to receive such notices from us, as they are informative and often contain instructions in relation to communications methods.

12

All e-mail accounts should be considered generic and are not tied to any particular person within any organisational unit, regardless of who has used and/or purported to use it previously or its prior purposes howsoever implied and/or inferred.

13

E-mails that have not been rejected transfer to a holding area on our system and during the next 42 days may be reviewed and/or responded to by various personnel (“Contractors”), should they determine in their absolute discretion, that a response is appropriate and/or necessary.

14

No liability is accepted for the incorrect or otherwise determination by any party which results in your e-mail not being delivered and/or processed. Time-sensitive correspondence regardless of content should not be sent via e-mail.

15

Please note our e-mail system is for our benefit not yours. If you have been provided with our consent to communicate with an address on our system, then we may withdraw that consent at any time, without any specific notice period and/or prior notification, and strictly on a without liability basis for any losses that you may suffer.

16

Should you fail to send e-mails to the correct address, or otherwise engage in conduct which we at our absolute discretion deem inappropriate, then your e-mail address and/or domain will be permanently blacklisted (often automatically and without human intervention) and your e-mails will be permanently rejected.

17

You agree that service of legal process is only accepted at the specific e-mail address of service@jsrds.legal . Legal process is not accepted by any other electronic means, including but not limited to facsimile and/or voice, either in relation to an authorised sender or in connection with a third-party, unless agreed a minimum of 42 days in advance.

18

Personal Service is not accepted via service@jsrds.legal and alternative arrangements must be made. The existence of an e-mail address for service does not mean that service is accepted electronically and a matter being brought to our attention does not necessarily mean valid service has been effected.

19

Service can only be effected by the litigant or its named lawyer – no third-party service (howsoever associated) is accepted. You agree that service attempted electronically supersedes any prior attempts and/or methods used. Documents must be in Adobe Portable Document format (“PDF”), colour scanned at a minimum of 300 dpi, or a PDF generated from a source document.

20

Court stamps, signatures and page numbering must be clearly visible with all pages sequentially and correctly numbered. Service of process is not accepted for officeholders and former officeholders of any corporate or organisational entity.

21

Each e-mail message (including PDF attachments) cannot be larger than 5Mb in size, and any large PDFs will need to be split accordingly to meet the 5Mb message limit, which means the PDF size would need to be smaller. Around 1Gb spread over multiple messages would be acceptable per service of documents and quality and legibility of documents is more important than the number of e-mails.

22

Each e-mail requires a concise meaningful subject, and a series of e-mails requires the text XXX of YYY in which XXX is the numbered e-mail in the series and YYY is the total number of e-mails being sent. Each individual PDF requires a meaningful name and needs to use the XXX of YYY labelling. The length of the filename has to be less than 80 characters.

23

Only an absolutely minimum amount of text should appear in the e-mail body (preferably none) as the system is designed to strip attachments and store them safely on multiple systems for processing by third-parties. Publicly verifiable digital signatures should be embedded in documents and used wherever possible, though this is not essential.

24

The documents sent via e-mail must be complete and no further communications and/or discussions should be required to deal with the matter. URLs containing documents for download are not accepted due to url-rewriting, the proliferation malware and the inability to download large attachments due to internet service provider limitations.

25

For service to be effected properly, the e-mail or series of e-mails needs to contain the entirety of documentation. Should additional materials be required then they will be requested once they are reviewed and date and time of service will be modified accordingly and/or if service is deficient for any reason.

26

Should service of legal process be accepted at service@jsrds.legal , then you irrevocably agree that the date and time of service is the system-generated autoresponse plus 42 days. As such today would be day -42 not day zero.

27

Sufficient time is required for the downloading of files from remote systems to local systems, a process which has been compromised by data exfiltration and has rendered electronic communications to become unreliable. These matters are public knowledge and evidence has been placed on various sites.

28

You agree that you will provide full and frank disclosure of all communications you send and receive from our systems (including but not limited to autoresponses such as these and all notifications in connection on associated systems, and conversations) to third parties including but not limited to law enforcement, military intelligence, the courts and in all judicial proceedings, and those in which the date, time, method of service and validity is relevant.

29

All authorisations for e-mail system access are expressly granted on the specific basis that the grantee will communicate with us in relation to our genuine mutual matters only, and not those of any third-party howsoever associated and/or ordered.

30

E-mails need to be addressed in a particular manner which will enable expedient processing and we may notify authorised senders of the applicable protocols. You agree that you will comply with our reasonable requests for information and/or documentation by e-mail and accept our lawful instructions.

31

Your use of this e-mail system for communication with any e-mail address confirms your consent to receive e-mail from any e-mail address and irrevocable acceptance of these terms as updated periodically, including but not limited to those presented, to the exclusion of all others. As such please do not communicate with us if you do not wish to be bound by these terms. [20190523 JSRDS E-MAIL ACCESS TERMS].
